Terms of service
1. Acceptance of Terms
By accessing or using the Monument Catios website or engaging our design, installation or consultation services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, please do not use our site or services.
2. Scope of Services
Monument Catios designs and installs outdoor cat enclosures (“catios”), indoor cat wall systems and window-box catios throughout Washington DC, Maryland and Virginia. Details of each offering appear on our Services page. All quotes are free and valid for 30 days unless otherwise stated.
3. Quotes, Deposits and Payment
A written quote becomes a binding service agreement once you provide written acceptance (email or e-signature) and pay a 25 percent deposit. Remaining balances are due upon substantial completion. Failure to pay may entitle us to place a mechanics’ lien under Maryland Real Property Code § 9-102 or equivalent statutes in DC/VA.
4. Cancellation and Termination
Either party may terminate an accepted project for any reason with 30 days’ written notice, or immediately for material breach. Client cancellations after materials are purchased may incur charges for non-returnable items and labor performed.
5. Schedule & Delays
Projected build dates are estimates. Weather, permit approvals or supply-chain issues may require rescheduling. We are not liable for delays beyond our reasonable control.
6. Warranty
We warrant workmanship and materials against defects for five (5) years from installation. This express warranty replaces all implied warranties to the extent allowed by law.
7. Client Responsibilities
You must:
• Secure HOA or landlord approval where required.
• Provide clear access to the work area on agreed dates.
• Supervise pets during installation.
Failure to do so may lead to additional charges or rescheduling.
8. Intellectual Property
All designs, drawings, photographs and copy on this site are our intellectual property. You may not reproduce them without written consent. An IP clause is essential to protect web and design content.
9. User Conduct
You agree not to (a) misuse our site, (b) attempt unauthorized access, or (c) post defamatory or infringing material. Violations may result in service refusal and legal action.
10. Marketing Communications
By ticking “Email Opt-In” or replying YES to our SMS prompt, you grant express written consent to receive marketing messages. You may unsubscribe anytime via the link in each email or by texting STOP, fulfilling CAN-SPAM and TCPA consent standards.
11. Limitation of Liability
To the maximum extent allowed by law, our aggregate liability for any claim arising from this Agreement will not exceed the amount you paid for the specific project.
12. Indemnification
You agree to indemnify and hold Monument Catios harmless from any third-party claims arising out of (i) your breach of these terms, or (ii) your misuse of our services.
13. Governing Law & Venue
This Agreement is governed by the laws of the State of Maryland without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Montgomery County, Maryland.
14. Dispute Resolution
Before filing suit, the parties agree to attempt in good faith to resolve any dispute through informal negotiation for 30 days, then non-binding mediation. If unresolved, litigation may proceed in the courts named above.
15. Changes to Terms
We may update these Terms and will post the revised version with a new “Last updated” date. Material changes apply 30 days after posting.
16. Severability
If any provision is held unenforceable, the remaining terms remain in full force.
17. Entire Agreement
These Terms, together with any accepted quote, constitute the entire agreement between you and Monument Catios and supersede prior discussions. If Client and Monument Catios later execute a written Project Agreement or Statement of Work, that document will control in the event of any conflict with these Terms.
18. media release
Client grants Monument Catios an irrevocable, perpetual, royalty-free license to photograph, record, publish and distribute images or video of the completed Project for portfolio display, website content, social-media posts, advertising, news features and other promotional uses. Monument Catios will not disclose the Client’s street address or identifying personal details without additional written consent. Client may withdraw permission for future, new uses by sending written notice, but existing publications will remain lawful.
